Terms of Service

Below is everything you need to know to obtain services from GeekGhost LLC, hereby referred to as GeekGhost. All users of our services are expected to read through our TOS and be familiar with what is and isn’t allowed on our servers. By signing up for our services you acknowledge having read and agree to this TOS.

All users of GeekGhost services, and all customers upon signing up for GeekGhost services, agree to comply with this Terms of Service (TOS). The purpose of our TOS is to ensure customers are using our services with due regard to the rights of other Internet users and in compliance with the requirements of GeekGhost’s network environment. GeekGhost reserves the right to add, delete, or modify any provision of this TOS at any time without notice, effective upon either the posting of the modified TOS to the www.GeekGhost.net website or notification of the modified TOS via Email. Any complaints about a customer’s violation of the TOS should be sent to abuse@geekghost.net. This TOS supersedes any other agreement with GeekGhost or it’s owners; written, oral, by conduct, or otherwise.
Violation of these policies may result in the suspension or termination of your account. GeekGhost shall not be held liable for any refunds, damages or data loss if your account is terminated for TOS violations. No Modification of this contract by customer is allowed.
1.) Account Setup / Email on file
We will setup your account after we have received payment and we and/or our payment partner(s) have screened the order(s) in case of fraud. It is your responsibility to provide us with an email address which is not @ the domain(s) you are signing up under in order ensure proper delivery of notifications. Setup is usually instant but if manual verification is needed, setup may be delayed until the account information is properly verified.
If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current or up to date at all times.
If you have a domain name registered with GeekGhost, it is your responsibility to ensure that the contact information for your domain account and your actual domain name(s) is correct and up-to-date. GeekGhost is not responsible for a lapsed registration due to outdated contact information being associated with the domain. If you need to verify or change this information, you should contact our sales team via email. Providing false contact information of any kind may result in the termination of your account.
In high risk transactions, it will be necessary to provide government issued identification and possibly a scan of the credit card used for the purchase Yuo may block out all info on the card image except for the last 4 digits of the credit card and the name). If you fail to meet these requirements, the order may be considered fraudulent in nature and be denied. We must have a valid contact details in order to provide service. This includes email (off server) as well as a valid telephone number and mailing address. GeekGhost reserves the right to deny access to your account until proper contact details are provided. We also reserve the right to request additional details to verify your identity such as copy of credit card used or proper ID.
Setup will not be activated until we can reach someone by phone to verify the order. To assure speedy set up and avoid order rejection, please include a valid telephone number.
GeekGhost reserves the right to refuse service at our sole discretion. We are based in the US. As such, GeekGhost cannot offer service to individuals residing in countries and/or territories under current US sanctions. Any falsified information during signup will result in refusal of service. Changing the main domain to your account after initial signup may result in additional fees. Accounts are non-transferrable. You must be 18 or older to acquire service from GeekGhost. The credit card holder or owner of the PayPal e-mail address which is utilized for payment on the account is designated as the authorized owner of the account.
2.)Account Migration
GeekGhost will make every effort to help you move your site to us. However, transfers are provided as a courtesy service, and we can not make guarantees regarding the availability, possibility, or time required to complete an account transfer. Each hosting company is configured differently, and some hosting platforms save data in an incompatible or proprietary format, which may make it extremely difficult if not impossible to migrate some or all account data. We will try our best, but in some cases we may be unable to assist you in a transfer of data from an old host. If the account needs to be migrated manually, additional fees may apply. No warranties or guarantees are made in terms of account migrations.
GeekGhost reserves the right to limit the number of transfers per account. If any of your scripts require changes to the code due to the new location or name of the databases, it is your responsibility to make these changes. If you cancel your account either under our 30 day money back guarantee policy or at any time after the migration has been requested and started on, a $35/per hour admin work fee will be applied to your account.
3.)Acceptable Content
All services provided by GeekGhost may only be used for lawful purposes. Examples of unacceptable content include, but are not limited to: copyrighted material, material we judge to be threatening or obscene, hate sites, illegal pornography (eg. kiddie porn [under legal age], bestiality), warez sites, proxy scripts, dangerous or insecure scripts. You agree to indemnify and  hold harmless GeekGhost from any claims resulting from the use of our services.
Use of our services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any account found to be in violation of anothers copyright will be removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be terminated from our network.

FORBIDDEN | UNACCEPTABLE CONTENT
The following are prohibited unless otherwise indicated:
• Cracked/pirated software, or material that violates copyright law
• Linking to cracked/pirated software, or material that violates copyright law
• Illegal songs, books, or videos
• Photos or images for which you do not own the copyright
• Eggdrops, torrents, virus/trojans, irc, irc files, irc scripts/bots, hack programs, hack archives, warez, pirated software (nor can you link to any of these items)
• Game servers (Allowed on Dedicated Servers and VPS)
• Hate, threatening or obscene sites (at GeekGhost’s sole discretion).
• XXX sites (Allowed Dedicated and VPS)
• Sites that link to unacceptable material as provided in this ToS
• Proxy scripts, shell scripts or scripts that allow ssh or simulated ssh access
• IP scanners
• Doubler, pyramid, HYIP, e-gold exchange, online currency exchange (not limited to Bitcoin, WoW, Linden/Second life, or Diablo III), or ponzi programs
• Free email accounts. You cannot use our service to supply free email accounts to users. We are not to be used as a free email service
• Sites from countries or regions under current US sanctions
• Sites or content that is not easily discernible or translated by our staff
• Outdated/vulnerable scripts. You must have any and all scripts uploaded to our servers updated to the latest secure version at all times
• Broadcast or Streaming of Live Sporting Events
• Commercial Audio Streaming (more than three streams)
• Sale of any controlled substance without prior proof of appropriate permit(s)
• Bruteforce Programs/Scripts/Applications
• Mail Bombers/Spam Scripts
• Lottery/Gambling Sites
• MUDs/RPGs/PBBGs
• Hacker focused sites/archives/programs
• Fraudulent Sites
• File Dump/Mirror Scripts (similar to rapidshare)
We DO allow nudity on any plan provided the material is not sexually explicit or links to sexually explicit material. If you are not certain whether your content is acceptable, please email admin@geekghost.net
We reserve the right to suspend any site that violates our TOS without notice. Account termination for TOS violation negates any refund for unused time.
All third party scripts must be the latest secure version. Failure to keep your scripts updated will result in suspension of account or other measures at GeekGhost’s sole discretion, including (but not limited to) removal of script by our techs. If an exploit through a script you have installed on your Web hosting space causes harm to our servers or otherwise affects the performance of our services we reserve the right to terminate your account for TOS violation. We will automatically remove any insecure script, this includes insecure software installations of any kind. We may also suspend the site at our sole discretion.
Final decision is up to GeekGhost management and admins. We will actively work with law enforcement officials to prosecute child pornography or those found to be breaking the law. It is your responsibility to adhere to both local and international laws. It is at GeekGhost’s sole discretion to decide whether your content is acceptable under these terms of service.
In terms of illegal content:
Resellers (Applies to Standard Reseller, Reseller Lite and Semi-Dedicated): we will suspend the site in question and will notify you so you may terminate the account. We will further monitor your activity; more than one infraction of this type may result in the immediate termination of your account.
Direct customers: Your services will be terminated with or without notice. Violations will be reported to the appropriate law enforcement agency.
GeekGhost services, including all related equipment, networks and network devices are provided only for authorized customer use. GeekGhost systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Using our service to purposely cause damage to another GeekGhost client is grounds for termination of the account. Use of GeekGhost system(s) constitutes consent to monitoring for these purposes.
Any account found connecting to a third party network or system without authorization from the third party is subject to suspension and even termination. Access to networks or systems outside of your direct control must be with expressed written consent from the third party. GeekGhost may, at its discretion, request and require further documentation to prove access to a third party network or system is authorized.
GeekGhost reserves the right to migrate servers as needed. In cases where services are being moved to a new geographical location, a best effort will be made to keep your new location as geographically close to the original location. No pro-rated refunds are made in cases where services are moved.
Failure to respond to email from our abuse department within 24 hours may result in the suspension or termination of your services. All abuse issues must be dealt with via trouble ticket/email and will have a response within 48 hours. Sites hosted on GeekGhost’s service(s) are regulated only by U.S. law. Given this fact, and pursuant to Section 230(c) of the Communications Decency Act, we do not remove allegedly defamatory material from domains hosted on our service(s). The only exception to this rule is if the material has been found to be defamatory by a court, as evidenced by a court order. GeekGhost is not in a position to investigate and validate or invalidate the veracity of individual
defamation claims, which is why we rely on the legal system and courts to determine whether or not material is indeed considered defamatory. In any case in which a court order indicates material is defamatory, libellous, or slanderous in nature; we will disable access to the material. Similarly, in any case in which a US Court has placed an injunction against specified content or material; we will comply and remove or disable access to the material in question. The language of Section 230(c) of the Communications Decency Act fundamentally states that Internet services providers like GeekGhost are re-publishers and not the publisher of content. Our service merely provides a hosting platform and space on which to host content, and any creation or publication of content on our services is the sole responsibility of the third-party user which creates or publishes the content. Therefore, GeekGhost should not be held liable for any allegedly defamatory, offensive or harassing content published on sites hosted under GeekGhost’s Web hosting service(s).
It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as username and password. It is required that you use a secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.
4.) Zero Tolerance Spam Policy
GeekGhost has a zero stance policy on SPAM, Junk E-mail or UCE. Spam, Junk-mail and UCE are defined as:
*The sending of the same, or substantially similar, unsolicited electronic mail messages, whether commercial or not, to more than one recipient. A message is considered unsolicited if it is posted in violation of a newsgroup charter or if it is sent to a recipient who has not requested or invited the message. UCE also includes e-mail with forged headers, compromised mail server relays, and false contact information.
This prohibition extends to the sending of unsolicited mass mailings from another service, which in any way implicates the use of GeekGhost whether or not the message actually originated from our network.
Block Removal
If Customer actions have caused GeekGhost’s mail servers or GeekGhost’s IP address ranges to be placed on black hole lists and other mail filtering software systems used by companies on the internet, Customer will be assessed a $500 charge to Customer account and $100 per hour for administrative charges incurred to remove and protect mail servers and IP ranges. If this is not paid within 24 hours, the account will be sent to our collection agency. Any account that causes blacklisting of our IP space will be terminated from our network.
“Drop-Box” Accounts. Using this network for the receipt of replies to unsolicited mass email (spam) sent from a third-party network is prohibited.
Header Forgery: Forgery of email headers (“spoofing”) is prohibited.
Proxy Spamming: Spamming via third-party proxy, aggregation of proxy lists, or installation of proxy mailing software is prohibited.
Relaying. Configuration of a mail server to accept and process third-party messages for sending without user identification and authentication is prohibited.
Comment Spam Posting: Posting unsolicited links or spammy links on other sites and blogs is strictly prohibited.
Mass Mailings: Sending mass unsolicited email is considered spam. Unsolicited email is defined as email sent to a recipient who has not double-opted in to mailings from the Customer. Senders of mass mailings must maintain complete and accurate records of all opt-ins, including the email and its headers if applicable, and provide such records to GeekGhost upon request. If positive and verifiable proof of opt-in cannot be provided, complaints from recipients of the mailing are considered proof they did not subscribe and the mailing is unsolicited.
Mailing Lists: GeekGhost’s mass mailing rules also apply to mailing lists, listservs, or mailing services contracted for by Customer. The policy is stated as follows: An acceptable mailing list will be focused at a targeted audience that has voluntarily signed up for e-mail information using a double opt-in process or that has made their e-mail address available to Customer for distribution of information. The list must also allow for automatic removal by all end Customers with non-distribution in the future.
5.)Free Domain Transfers
If you were provided a free domain transfer or registration with your account, you must request this within 30 days. Transfer requests after 30 days will incur the standard registration fee. Free domain registration or transfer offers are not valid with use of a hosting coupon code unless otherwise specified.
6.) Payment Information
You agree to supply appropriate payment for the services received from GeekGhost, in advance of the time period during which such services are provided. You agree that until and unless you notify GeekGhost of your desire to cancel any or all services received, those services will be billed on a recurring basis.
GeekGhost reserves the right to adjust pricing plans and optional fees.
There is a 24 hour grace period on payments. Your account is in risk of suspension if payment is not received by 12:01am the day after your account is due.

Payments made with E-check may take 4-10 days to clear. If using E-check, please allow enough time before your payment due date as pending E-check payments do not constitute a paid invoice and past due accounts are still subject to suspension.After 10 days past due a $5 late fee may be applied to your account.

Chargebacks or Paypal disputes will result is account cancellation with zero refund regardless of the outcome. We work hard for our clients and always refund when within our TOS, AUP and SLA. If a chargeback or paypal dispute is filed, GeekGhost will no longer conduct business with the client and all files, accounts and services will be terminated.
6a.) Suspension for Non-Payment

If your account is suspended for non-payment, a $5 reinstatement fee will be incurred. If your plan has been discontinued you will loose any grandfathered in status and be required to move to a current plan at the current published rates and/or any discounts will be removed.

7)Cancellations and Refunds
GeekGhost reserves the right to cancel, suspend, or otherwise restrict access to the account at any time with or without notice.
Any abuse of our staff in any medium or format will result in the suspension or termination of your services. We’ll always treat you with repect. Please do the same.
If not cancelling within the first 30 days, the cancellation will be effective as of your next billing date. This applies to monthly, quarterly, semi-annual annual, 2 year and 3 year payments.
High Resource and Shared plans offer a 30 day money back guarantee if you cancel your plan within the first 30 days of signup. Only the hosting portion is refundable. SSL, domains, billing software, etc are non refundable. If you received a domain, SSL or billing system with your account, fees will be deducted from your refund to cover the cost of providing these add ons.  Fusion, Semi Dedicated, VPS and Dedicated hosting do not provide a money back guarantee and require 15 days advance notice of cancellation.
We reserve the right to refuse a refund if we find that you used your account against our Terms of Service or if we migrated your site to our servers manually.
Our 30 day refund policy applies to new clients only. If you’ve ever had an account with GeekGhost, you do not qualify for the 30 day money back guarantee. When requesting cancellation within the first 30 days, no refund will be issued if you select to keep your account until the next renewal date. Cancellations to obtain the 30 day money back guarantee must be elected for immediate termination.
If you submit a cancellation to take affect as of the next billing date and plan to request a refund under our 30 day money back guarantee, no further support will be offered for your account. You are welcome to stay on until your expiration date but support will be limited for your account to server or service down issues only.
7a.) Money Back Guarantee per Plan
Shared Hosting and Business Grade : 30 day money back guarantee policy
You may cancel your shared hosting plan within the first 30 days and receive a full refund of the hosting portion of your payment if you are not completely satisfied. After the first 30 days, you may cancel at any time. However, your cancellation will be effective as of the next billing date.
Fusion, Semi-Dedicated, VPS, and Dedicated : No refund policy. Cancellations must be made 15 days in advance of your next renewal date.
Money back offer ONLY for first time customers
Add-ons, Domain names and set up fees are NON-REFUNDABLE.
SSL, install fees, IPs, ClientExec, BoxBilling or WHMCS license fees are NON-REFUNDABLE
If you requested our account migration service, fees may be deducted for this if cancelling after the work was completed.
On Reseller Hosting, if you request your free ClientExec, BoxBilling or WHMCS license, and in turn cancel your plan, we will assess a $5 license restocking fee to your account.
If cancelling under the 30 day money back guarantee, please allow up to 10 business days for your refund to process.

We reserve the right to refund a prorated amount or no refund at all if you were found in discordance with our TOS.

For 3rd party updates and installs or any other billable service, you are being billed for the time. If you provide an incomplete install file or the object of installation is later found to not be incompatible no refund will be offered.

No refunds on domain registrations, SSLs or Domain transfers. No refunds on Server administration unless work was not completed.No refunds on 3rd party support.

7b.)Upgrade/DownGrade Policy
You can upgrade your hosting at any time. There are no additional fees other than the pro-rated difference between plans.
Plan downgrades are effective as of your next billing date.
8.) Backups and Data Loss

Your use of this service is at your sole risk. Our backup service runs nightly, overwrites any of our previous backups made, and only the previous night’s backup is saved.

This service is provided to you as a courtesy. GeekGhost is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on GeekGhost servers. This service is only to restore your account on our servers. If you require a backup to move your files you must take a backup from within your control panel.
We make no guarantees on the integrity of a backup.
Remember that ultimately, backups are your responsibility and GeekGhost makes no guarantees as to having a backup available of your lost data.
9.) Resource Usage
Shared and Reseller users may NOT:
1) Use 25% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as (but not limited to) IRCD.
3) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
4) Run any software that interfaces with an IRC (Internet Relay Chat) network.
5) Run any bit torrent application, tracker, or client. You may not link to legal torrents off-site, nor host or store them on our shared servers.
6) Participate in any file-sharing/peer-to-peer activities
7) Run any gaming servers such as (but not limited to) Source-based, Minecraft, or Call of Duty.
8) Run cron entries with intervals of less than 15 minutes.
9) Run any MySQL queries longer than 15 seconds. MySQL tables should be indexed appropriately.
10) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php“) use include(“include.php”)
11) Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.

12) Use our services as personal file storage

Business Grade and WordPress Webmaster plans may NOT:
1) Use 50% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as (but not limited to) IRCD.
3) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
4) Run any software that interfaces with an IRC (Internet Relay Chat) network.
5) Run any bit torrent application, tracker, or client. You may not link to legal torrents off-site, nor host or store them on our shared servers.
6) Participate in any file-sharing/peer-to-peer activities
7) Run any gaming servers such as (but not limited to) Source-based, Minecraft, or Call of Duty.
8) Run cron entries with intervals of less than 10 minutes.
9) Run any MySQL queries longer than 30 seconds. MySQL tables should be indexed appropriately.
10) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php“) use include(“include.php”)
11) Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.
12) Use our services as personal file storage
Semi-dedicated plans may NOT:
1) Use 75% or more of system resources for longer then 90 seconds. There are numerous activities that could cause such problems; these include: CGI scripts, FTP, PHP, HTTP, etc.
2) Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as (but not limited to) IRCD.
3) Run any type of web spider or indexer (including Google Cash / AdSpy) on shared servers.
4) Run any software that interfaces with an IRC (Internet Relay Chat) network.
5) Run any bit torrent application, tracker, or client. You may not link to legal torrents off-site, nor host or store them on our shared servers.
6) Participate in any file-sharing/peer-to-peer activities
7) Run any gaming servers such as (but not limited to) Source-based, Minecraft, or Call of Duty.
8) Run cron entries with intervals of less than 5 minutes.
9) Run any MySQL queries longer than 30 seconds. MySQL tables should be indexed appropriately.
10) When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php“) use include(“include.php”)
11) Only use https protocol when necessary; encrypting and decrypting communications is noticeably more CPU-intensive than unencrypted communications.
12) Use our services as personal file storage
On all plans, databases must not pose a threat to server stability. Excessively large databases are best suited for VPS or dedicated plans.
10.)Configuration Changes and Module Requests
We do not honor any configuration changes or module requests on reseller or shared production servers. Module, security, or configuration change requests are accepted on Semi dedicated plans upon approval. You are, of course, able to install any modules or change the configuration on VPS or dedicated servers. On Uber hosting plans, these requests are considered upon approval. If the change or module is experimental, we may not enable the function as it could adversely affect the other users on the server. Changes to Mysql or PHP versions, as well as other server software, are not honored on these servers. In addition, GeekGhost reserves the right to charge our standard admin fee to implement changes on your behalf. If such a change is made or module/software added there is guarantee that we can support it.

11.)Bandwidth Usage
You are allocated a monthly bandwidth allowance. This allowance varies depending on the hosting package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until more bandwidth is purchased at an additional fee, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month. Bandwidth overage charges are at .15 (15 cents) per 1GB. Any overages must be paid when invoiced. Failure to do so will result in the invoice being forwarded to a collection agency and legal counsel. If you’d like to make payment arrangements for an outstanding overage invoice, please contact our billing department.
12.)Indemnification
Customer agrees that it shall defend, indemnify, save and hold GeekGhost LLC harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against GeekGhost.net, its agents, its customers, its owners and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless GeekGhost.net, it’s owners and partners against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with GeekGhost.net; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (3) copyright infringement and (4) any defective products sold to customers from GeekGhost.net.
You agree to hold any and all litigation in a Florida court.
GeekGhost.net will not be responsible for any damages your business may suffer. GeekGhost.net makes no warranties of any kind, expressed or implied for services we provide. GeekGhost.net disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions caused by GeekGhost.net, it’s owners, and/or its employees or partners. GeekGhost Hosting reserves the right to refuse service. We reserve the right to limit what scripts and software is uploaded to our servers.
13.)Maintenance
GeekGhost.net designates time periods (“Scheduled Maintenance Windows”) during which it may limit or suspend the availability of the hardware and/or software involved in providing its Services and Products (an “Outage”) to perform necessary maintenance or upgrades. Scheduled Maintenance Windows currently are between the hours of 12am and 5am Eastern Standard Time. If planned maintenance has the possibility of making the server or servers, as the case may be, utilized by Customer inaccessible to the Internet during a Scheduled Maintenance Window, GeekGhost.net will provide not less than three (3) hours prior electronic mail or other notice to Customer of the Scheduled Maintenance Window during which the Outage is planned. GeekGhost reserves the right to conduct maintenance withour prior notice if the situation is urgent.
GeekGhost reserves the right to make any changes to our servers without prior approval from our clients. These changes may be for performance or maintenance reasons. We are not responsible for any adverse affects our changes may have on your files, databases or configurations. Downtime due to maintenance periods do not count against uptime guarantee.

14.)Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to choice of law provisions that would cause the application of the law of another jurisdiction.

15.)Uptime Policy
GeekGhost.net promises to have your shared, Business grade, reseller, Uber, VPS or dedicated hosting account up 99.9% of the month. This excludes all scheduled maintenance, reboots, self inflicted downtime, acts of god, backbone issues, DoS or DDoS attacks, SYN_FLOOD attacks, hardware failures or data center induced outages. Your shared, reseller or Uber account will be credited in accordance to the list below:
  • 100% – 99.9% uptime : No credit
  • 99.9% – 99.5% uptime : 10% credit
  • 99.4% – 99% uptime : 20% credit
  • 89.9% – 98% uptime : 30% credit
  • 97.9% – 97% uptime : 40% credit
  • 96.9% – 95% uptime : 50% credit
  • Less than 95% uptime : 100% credit
  • Your VPS or Dedicated server account will be credited 1% of your bill for very 60 minutes that you are down not to exceed 50% of your monthly fee if we fail to keep our uptime guarantee. In terms of VPS and dedicated servers, the 99.9% uptime guarantee applies to network only and not hardware failures or system failures as we do not manage these systems.To claim an uptime credit, please submit a support request via the helpdesk under the “billing” category and post your site monitor logs.For accurate uptime monitoring please use a third party monitoring system.16.)Right to Terminate
    Any domain that causes harm, damage, crashes or otherwise compromises or affects other users will be terminated. We reserve the right to terminate any account we find to be hosting or storing files against our TOS. You are allowed to copy our TOS only. All other GeekGhost content is copyrighted. This especially holds true for our testimonials. Under no circumstances can you copy our testimonials. Doing so may result in losing your account.Any user in violation of this policy will have their site suspended and asked to remove it. Failure to do so will result in account termination. GeekGhost reserves the right to terminate your account without warning if your offense is endangering the integrity or performance of our servers.DoS attacks or any other attacks launched from within our servers or against our servers may result in your account being terminated. Determination is at GeekGhost.net’s sole discretion.GeekGhost.net reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with this TOS or hinders performance on our servers, at our sole discretion. GeekGhost.net also reserves the right to make any such modifications in an emergency at our sole discretion.Domains placed on our servers must resolve to our servers. It is your responsibilty to provide an offsite email address as your primary contact where you can be reached in case issues arise. We must also have a valid phone number on file as verified when placing your order.

      –> GeekGhost.net offers 24/7/365 support via Support Ticket via our Help Desk located at https://account.geekghost.net/
      –> Live Chat support is offered at various shifts as available and only available to Resellers, Business Grade, Managed VPS or Dedicated clients only. Live chat through our website is for minor cpanel/WHM issues, pre-sales and quick answers to basic questions. For more in-depth issues or for complete support please use the helpdesk.
      –> We do not offer telephone support at this time. Clients are welcome to call in case of server down and unavailable help desk. Emails to admin seeking support will go unanswered. Please use the proper channels when requesting support. You are always welcome to request a call back from a tech but this must be done via the ticket system. We must keep logs of all support requests and support history and the most efficient way to do this is through the ticket system.
      –> Support is only provided to the main account holder. If there will be additional staff or users requesting support for your organization, please email billing(at)GeekGhost.net with a list of authorized users and what permissions they have to request support for…IE password change, IP move, sales, billing, etc.We do not support any third party scripts or code. This includes updating your script. If you are not able to update your script to the latest version using our script installer, then a manual update will be needed. If you require us to update your script manually for you, additional charges will incur. We do not offer assistance with mail scripts, custom email configurations or database issues unless the issue is serverside. We are happy to investigate server side issues and resolve as necessary and available. Restore requests of databases will incur additional fees.
    We do not offer Frontpage support.
    We do not support changes you make to your default DNS settings. Any changes you make to the standard DNS configuration remain your responsibilty. The extent of our support on these issues is restoring DNS settings to default.
    Additional Support Stipulations and Limitations
    Reseller and Uber Hosting – We do not offer support for your users/clients. If you need to migrate a client to our servers and they are on a current cPanel based server, we will do so free of charge.
    18.)Reseller Clause
    For the purpose of this TOS, Reseller is defined as any account with access to placing hosting accounts on our servers. Reseller Hosting, Reseller_lite and Uber plans fall under this category.
    GeekGhost.net offers our Resellers the opportunity to grow. To that extent, we allow our resellers to oversell their allotted disc space by default and bandwidth upon request. To request bandwidth overselling, please submit a support request through the Help Desk.
    You agree to promptly pay invoices for such overages if your account exceeds your originally paid for configurations and/or limitations. Failure to pay for the extra resources may result in the suspension or termination of your account, at GeekGhost.net’s sole discretion.
    Resellers must support their own clients.  We will not deal with your customers in any way or resolve any of your clients’ technical issues.
    It is the resellers’ responsibilty to secure their clients’ scripts. Resellers are not permitted to be a free hosting provider. You are of course allowed to offer free hosting to friends family and business associates but a business plan based on providing free hosting is not allowed on our servers.
    GeekGhost reserves the right to suspend or terminate any domain hosted on our servers. GeekGhost will remove any reseller’s resold accounts from our servers that have remained in suspended status for 60 days or more unless prior arrangements are made.
    Resellers are responsible for any and all content placed on our servers by any domain in their reseller block. While we normally simply suspend or terminate the offending domain, we reserve the right to suspend all of your accounts or your entire reseller status depending on the severity of the violation. Resellers are responsible for any outdated or insecure scripts hosted on any domain in their reseller block. As we do not have access to your clients, it is important that you respond to and fulfill any requests made by our staff in terms of securing or updating any scripts hosted by your reseller account. Failure to do so may result in suspension of the domains in violation.
    Under no circumstances can a reseller or client copy our customer testimonials. Doing so may result in losing your account. Our customer testimonials are real and attained through dedication and hard work. Copying them is unfair to us, our clients and your potential customers. You are welcome to and in fact encouraged to use our TOS, AUP and Privacy Policy.
    If your accounts lead to several TOS violations and we deem you to be an unreliable reseller (content placed on our server is not safe and various violations have occurred) we reserve the right to suspend/terminate the entire reseller account at GeekGhost’s sole discretion.
    Your free ClientExec, Boxbilling or WHMCS license or other free licenses we may provide to you is for use on our servers only. If the domain that your license is issued to ceases to resolve to our server, GeekGhost reserves the right to remove your license from our database.
    19.)Affiliates
    You agree to NOT SPAM your referral link or coupon code any any Web sites, forums or email. This policy is strictly enforced and violation of this policy will result in termination of your affiliate status and forfeiture of any earned commissions. Commission payouts are made when your account reaches $100 and a request is made to pay. This includes the $25 bonus deposit we make in to your account. Early payouts can be requested but it will void the $25 bonus in your account. Account must be in good standing for payout to occur. If your account was cancelled for non payment you forfeit your affiliate commissions. You must have a valid, active account with us to maintain your affiliate status. A grace period will be allowed if there are no active services but after 90 days your affiliate account can be terminated and you will forfeit any commissions.We reserve the right to modify or cancel our Affiliate Program at any time and without notice.
